IMPORTANT NOTICE: Please read these Terms carefully before purchasing. By completing your purchase, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not complete your purchase.

1. PARTIES AND ACCEPTANCE OF TERMS

These Terms of Service („Terms”) constitute a legally binding agreement between:

Client: the individual completing the purchase („you”, „your”, „Client”)

By accessing your-astrology-advisor.com and purchasing our services, you confirm that:

You have read and understood these Terms in full;
You are at least 18 years of age and have full legal capacity to enter a binding agreement;
You accept these Terms without reservation.

If you do not agree to these Terms, do not use our website or purchase our services.

2. DESCRIPTION OF SERVICES

Your Astrology Advisor provides personalized birth chart analysis reports based on Vedic astrology principles. Available services:

Single Question Analysis – €40
Comprehensive Life Analysis – €100

All services are delivered as digital PDF reports sent to the email address you provide, typically within 24–48 hours of receipt of your complete birth data.

3. NATURE OF SERVICE AND DISCLAIMER

3.1 Personalized Digital Product

The birth chart analysis is a bespoke digital service prepared individually and exclusively for you, based on the specific birth data you supply. Each analysis is unique and cannot be reused or reassigned to another person.

3.2 Entertainment and Self-Discovery Purposes Only

This service is provided for self-discovery, personal reflection, and entertainment purposes only. Astrology is an interpretive art, not an empirical science recognized by the scientific community. The analysis DOES NOT constitute, and must not be relied upon as:

Medical, psychological, or psychiatric diagnosis or treatment;
Financial, investment, or business advice;
Legal counsel or any other form of professional advice.

You are solely responsible for all decisions and actions you take. Do not use this analysis as a substitute for qualified professional advice in any area of your life.

4. PAYMENT AND PRICING

4.1 Payment Processing

All payments are processed securely through Stripe. We accept major credit and debit cards and other payment methods available via Stripe at the time of purchase.

4.2 Pricing and VAT

Prices are displayed in EUR (€). Where applicable, VAT is included in the displayed price in accordance with EU and local tax regulations. We reserve the right to modify prices at any time; however, the price applicable to your order is the price displayed at the moment you complete your purchase.

4.3 Order Confirmation

You will receive an order confirmation email once payment is successfully processed. This confirmation does not constitute acceptance of your order; acceptance occurs when we begin preparation of your analysis.

5. RIGHT OF WITHDRAWAL (EU AND UK CONSUMERS)

5.1 Standard Right

Under the EU Consumer Rights Directive 2011/83/EU and UK Consumer Contracts Regulations 2013, consumers generally have a 14-day right of withdrawal from distance contracts.

5.2 Waiver of Withdrawal Right – Digital Content and Personalised Services

By completing your purchase and submitting your birth data, you expressly acknowledge and agree that:

The service constitutes the supply of digital content not supplied on a tangible medium (Article 16(m), Directive 2011/83/EU; Regulation 28, UK CCR 2013), performance of which begins immediately upon your express request and with your prior informed consent;
The service additionally constitutes a contract for the supply of goods or services clearly personalised to you (Article 16(c), Directive 2011/83/EU), meaning it cannot be resold or otherwise supplied to a third party;
You consent to the immediate commencement of performance before the 14-day withdrawal period expires;
You acknowledge that, as a consequence, you will lose your right of withdrawal once performance has commenced.

This waiver is given in full compliance with applicable consumer protection law. If you do not wish to waive this right, do not complete your purchase.

6. REFUND POLICY

6.1 General – All Sales Final

Due to the bespoke, personalised, expert-driven, and immediately performed nature of the service, all sales are final once performance of your analysis has commenced. Refunds will not be issued on the following grounds:

Subjective dissatisfaction with the content, style, or conclusions of the analysis;
Disagreement with the astrological interpretation or findings;
Change of mind after purchase;
Personal scepticism regarding astrology or its validity;
Receiving a different reading or interpretation from another practitioner.

6.2 What You Are Paying For

Your payment covers the time, expertise, research, and analytical process applied to your personal data. It does not guarantee any specific outcome, result, or conclusion.

6.3 Verified Service Provider Error

If we commit a verifiable material error solely attributable to us (e.g., we enter your birth data incorrectly despite you having provided it correctly and in full), we will provide a corrected analysis free of charge within 5 business days of the verified error being identified. This constitutes full and adequate remediation.

This exception does not apply to errors caused by inaccurate, incomplete, or ambiguous data you have provided.

6.4 Technical Delivery Failure

If the PDF report is undeliverable due to a technical failure on our part (e.g., the file is blank or irrecoverably corrupted and the fault lies exclusively with our delivery process), we will re-deliver the report within 3 business days of your notification.

7. CLIENT RESPONSIBILITIES

7.1 Accuracy of Birth Data

You are solely responsible for supplying accurate, complete, and up-to-date birth information, including:

Full name;
Exact date of birth;
Exact time of birth (to the nearest minute, if known);
Exact place of birth (city and country).

7.2 Authorisation to Submit Third-Party Data

If you submit birth data of a third party, you expressly represent and warrant that you have obtained that person’s explicit, freely given, informed, and specific consent to share their personal data with us for the purpose of obtaining an astrological analysis. You shall indemnify and hold us harmless from any claim, loss, or liability arising from unauthorised submission of a third party’s personal data.

7.3 Consequences of Inaccurate Data

If you provide incorrect, incomplete, or approximate birth data, the resulting analysis will reflect that data and may be materially inaccurate. This does not constitute an error on our part and does not entitle you to a refund, free correction, or any other remedy.

7.4 Unknown Birth Time

If you do not know your exact birth time, please state this clearly when ordering. We may, at our discretion, apply solar chart methodology or astrological rectification techniques. You accept these methodological limitations and their potential impact on the accuracy of the analysis.

7.5 Correction Fee

Any request for a new analysis based on corrected data you provide after delivery (e.g., supplying a different birth time than originally stated) will be treated as a new order subject to full payment.

7.6 Email Address

You must provide a valid, monitored email address at the time of purchase. We are not liable for non-delivery caused by incorrect email addresses, full mailboxes, overly aggressive spam filters, or other causes within your control. Please check your spam or junk folder.

8. DELIVERY

8.1 Method

Your completed analysis will be delivered as a PDF report to the email address you provided at the time of purchase, and/or via digital download through your account on our website.

8.2 Timeline

Standard estimated delivery time: 24–48 hours from receipt of your complete and correct birth data. This is an estimate, not a contractual guarantee. Delivery within 7 calendar days is considered timely performance under these Terms.

Delivery may be delayed in exceptional circumstances (illness, force majeure). We will notify you as soon as reasonably practicable if a significant delay is expected.

8.3 Reporting Technical Issues

You must report any technical issues with the delivered file (e.g., blank document, corrupted PDF) within 48 hours of delivery. Failure to report within this timeframe constitutes acceptance of the delivered report.

9. LIMITATION OF LIABILITY

9.1 Liability Cap

To the maximum extent permitted by applicable mandatory law, our total aggregate liability to you for any and all claims arising out of or in connection with your use of our service shall not exceed the amount you actually paid for the specific analysis giving rise to the claim.

9.2 Excluded Losses

To the maximum extent permitted by mandatory law, we exclude liability for:

Any indirect, consequential, incidental, or special losses;
Loss of profits, revenue, business, or anticipated savings;
Decisions made or actions taken by you in reliance on the analysis;
Emotional distress or psychological harm.

9.3 Mandatory Consumer Rights

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable mandatory consumer protection law (including Polish law, EU consumer law, and UK consumer law where applicable). Your statutory rights as a consumer are not affected by these Terms.

9.4 Client Responsibility

You assume full responsibility for how you choose to interpret and apply the information in your analysis. Disagreement with the analytical findings does not constitute a breach of contract or service failure on our part.

10. COMPLAINTS AND DISPUTE RESOLUTION

10.1 How to Lodge a Complaint

10.2 Response Timeline

We will acknowledge your complaint within 2 business days and provide a substantive response within 14 calendar days of receipt. Where the matter requires further investigation, we will notify you of the expected resolution timeline.

10.3 Alternative Dispute Resolution (ADR)

If we are unable to resolve your complaint to your satisfaction, you may refer your dispute to an accredited alternative dispute resolution body. For EU consumers, the European Commission’s Online Dispute Resolution (ODR) platform is available at:

10.4 Payment Disputes and Chargebacks

Before initiating a chargeback or payment dispute with your bank or card provider, you agree to contact us directly to resolve the matter. We commit to responding within 3 business days. In the event of a chargeback, we will provide full evidence of order completion, data submission, and delivery to the payment processor.

11. INTELLECTUAL PROPERTY

All analyses, reports, and materials we produce remain our exclusive intellectual property. Upon delivery of a paid analysis, we grant you a personal, non-exclusive, non-transferable licence to use the report for your own private purposes only. Without our prior written consent, you may not:

Redistribute, resell, or otherwise commercially exploit the analysis;
Publish or share the analysis (in whole or in part) on any public platform or social media channel;
Create derivative works for commercial purposes.

12. DATA PROTECTION AND PRIVACY

12.1 Data Collected

We collect and process: your name, email address, birth data (date, time, place), and payment transaction ID.

12.2 Legal Basis and Purpose

We process your data on the basis of contractual necessity (Article 6(1)(b) GDPR) to create and deliver your analysis, and to communicate with you about your order. Financial records are retained for 5 years to meet our legal obligations under Polish tax law (Article 6(1)(c) GDPR).

12.3 Retention

Birth data: retained for 12 months for quality assurance purposes, then permanently deleted.
Financial records: retained for 5 years in compliance with tax law.
Order-related correspondence: retained for 3 years from the date of your order.

12.4 Your Rights (GDPR / UK GDPR)

You have the right to: access your personal data; rectify inaccurate data; request erasure (subject to legal retention obligations); restrict processing; and lodge a complaint with the Polish Personal Data Protection Office (UODO) at www.uodo.gov.pl, or the UK ICO at www.ico.org.uk if you are a UK resident. Requests are fulfilled within 30 days.

12.5 Data Transfers

We use Stripe for payment processing and standard email infrastructure for delivery. These processors may be located outside the EEA. Where applicable, transfers are conducted in accordance with standard contractual clauses or equivalent safeguards.

13. GOVERNING LAW AND JURISDICTION

13.1 Governing Law

These Terms are governed by the laws of the Republic of Poland, without prejudice to any mandatory provisions of consumer protection law applicable in your country of habitual residence.

13.2 Jurisdiction

Disputes shall be subject to the non-exclusive jurisdiction of the courts of Dębica, Podkarpackie, Poland. However, if you are a consumer habitually resident in an EU Member State or the United Kingdom, you retain the right to bring proceedings before the courts of your country of habitual residence and to benefit from any mandatory consumer protection provisions of your local law that cannot be derogated from by agreement.

13.3 Amicable Resolution

Both parties agree to attempt amicable resolution of any dispute through direct negotiation before initiating formal legal proceedings.

14. MISCELLANEOUS

14.1 Modifications

We reserve the right to update these Terms at any time. The version in effect at the time of your purchase governs that transaction. The „Last Updated” date at the top of this document indicates the most recent revision.

14.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

14.3 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Piotr Szczech (Your Astrology Advisor) with respect to your use of this website and the purchase of our services, and supersede all prior representations, warranties, and understandings.

14.4 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision at any future time.
